A contentious legal battle involving Elon Musk’s xAI and the NAACP has taken a surprising turn, with the Department of Justice (DOJ) stepping in to support xAI. At the heart of the dispute are dozens of unpermitted natural gas turbines powering xAI’s data centers near Memphis, an issue the NAACP claims is severely impacting local air quality.

The DOJ filed a memorandum on Monday, arguing that if the NAACP’s lawsuit prevails and the turbines are shut down, it would undermine “American national, economic, and energy security.” The department asserts that this move would essentially cut off power to critical artificial intelligence innovation that directly supports the Department of War’s military operations, including recent strikes in Iran.

The Battle Over “Mobile” Turbines

The NAACP initially signaled its intent to sue xAI last June, aiming to halt the company’s use of numerous “mobile” gas turbines at its Colossus and Colossus 2 data centers. Despite these early efforts, xAI has since expanded its operations, bringing the total number of turbines to 57, more than doubling their count since last year.

xAI maintains that because these turbines remain on trailers, they are exempt from Mississippi’s air pollution regulations for a period of one year. However, the Southern Environmental Law Center, representing the NAACP, contends that this setup still violates federal law, which can classify trailer-mounted turbines as stationary and thus subject to stringent environmental regulations.

Public Health and Environmental Concerns

The NAACP has voiced grave concerns over the deteriorating air quality in the region since xAI’s data centers became operational. This area already bears the burden of being one of the most polluted in the country, and residents report a noticeable decline in environmental conditions.

The increase in turbines has led to a corresponding surge in three major air pollutants: PM2.5, formaldehyde, and oxides of nitrogen (NOx). All three are known health hazards, linked to serious conditions like asthma and cardiovascular disease. Formaldehyde exposure specifically elevates the risk of cancer, while PM2.5 has been implicated in a wide range of ailments, from strokes to Alzheimer’s disease.

xAI’s Future Power Expansion

Despite the ongoing legal and environmental challenges, xAI, now operating as a division of SpaceX, appears poised for significant expansion of its power infrastructure. SpaceX’s recent IPO filing revealed ambitious plans to acquire an additional $2.8 billion worth of gas turbines over the next three years to power its burgeoning AI data centers.

A substantial portion of this investment, at least $2 billion, is specifically earmarked for “mobile gas turbines,” indicating a continued reliance on this controversial power generation strategy. This commitment suggests the legal and environmental debate surrounding xAI’s operations is far from over, with profound implications for both national security and public health.
